By accessing and using Thumblytics ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Service Description

Thumblytics provides AI-powered YouTube thumbnail analysis. The Service uses artificial intelligence to evaluate thumbnails and provide recommendations. We do not guarantee specific results or outcomes from using our analysis.

3. Payment Terms

All payments are processed securely through Paddle, our trusted payment partner. We accept:

• International payments: Credit/debit cards ($1.99 USD per analysis)
• India payments: UPI (PhonePe, Google Pay, Paytm, etc.) at ₹199 INR per analysis

Credits are added to your account immediately upon successful payment. Each analysis costs 10 credits. Credits do not expire but are non-transferable and non-refundable except as described in our Refund Policy.

4. User Conduct

You agree not to:

• Upload inappropriate, offensive, or illegal content
• Attempt to abuse, reverse engineer, or exploit the Service
• Share your account credentials with others
• Use the Service for any unlawful purpose
• Attempt to bypass payment or credit systems
• Use automated tools to access the Service without permission

5. AI Analysis Disclaimer

Our Service uses artificial intelligence (Google Gemini) for thumbnail analysis. While we strive for accuracy, AI can make mistakes. All analysis results are provided "as is" without warranties.

Users should review and verify all recommendations before implementing them. We are not responsible for results or outcomes from applying our AI-generated suggestions.

6. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms of Service. In cases of termination for violations, remaining credits may be forfeited without refund.

7. Limitation of Liability

Thumblytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

8. Intellectual Property

You retain ownership of thumbnails you upload. We process them solely to provide analysis. Analysis results and recommendations are provided for your use. Our Service, technology, and branding remain our intellectual property.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in accordance with the dispute resolution provisions outlined in our Refund Policy.
